IV. Owners Obligations:
A. Owner agrees to pay all fees that
are due to WRS at the time of service or within a time frame that has been
agreed upon with both parties in question. The fees that WRS charges
have been provided to the said Owner at time of Contract delivery.
If all charges are not paid within 60 days of the services provided, the
semen in question will be destroyed.
B. Owner will not hold WRS or
associated parties responsible for any illness, or death of said animal
that happens in the duration of the time that WRS was handling the
collections, or processing the said animal's semen. Owner will not
hold WRS responsible for any illness, or death of the mares that are being
bred with the frozen semen that WRS has processed and frozen.
C. Owner agrees to not hold WRS
responsible for any loss or damage of said semen that is in storage at
WRS. Owner agrees to seek insurance elsewhere if they so see it
necessary.
D. Owner agrees to allow WRS to do a
post-thaw evaluation on said animal's semen after the freezing process is
complete. Owner agrees that WRS has the option of evaluating as much
semen as possible to do a thorough post-thaw evaluation.
E. Owner agrees that semen that did not
meet the minimum quality standard of 30% Post-thaw progressive motility,
will not be made available to mare owners without a disclaimer statement
from WRS. This disclaimer will state that the semen in question did
not meet the minimum quality standards of WRS and WRS will not be
responsible for negative pregnancies associated with said
semen.
F. Owner agrees to test breed with the
said stallions semen before shipping it to any mare owners. This
test breeding mare will need to be in foal 21 days before
notification to WRS for first shipment to be shipped out.
V. WRS's Obligations:
A. WRS agrees to collect, process and
freeze the said animal's semen and do so in a professional and timely
manor. WRS reserves the right to refuse to freeze a said animal on basis
of their semen quality.
B. WRS makes no guarantee of the
fertility capabilities of the semen that has been processed.
C. WRS reserves the right to
discontinue service with the said Owner if any breech of this contract has
been made.
VI. Contract Bindings:
A. This contract shall be construed
under and in accordance with the laws of the State of Texas.
B. No modifications, waiver or
termination of this contract shall be binding unless executed in writing by
the said parties and in accordance with the laws of the State of Texas.
C. A Collection and processing deposit
of $100 is due at the time of submission of this contract to WRS. A
written statement will be given to the said Owner or Agent at the time of
completion of services provided. This amount is due in full at that
time.
